Terms of Service.

By creating an account, visiting our paid surfaces, or entering a Home Owners Club (HOC) draw, you accept these terms. We update them from time to time and post material changes to all members. Continued use after a material change is acceptance of the updated terms.
1. Provider
The service is provided by Home Owners Club Pty Ltd, an Australian company (ABN TBA), referred to as "HOC", "we", or "us" in these terms. The service is available at homeclub.com.au and any related subdomains.
2. What we do
HOC provides:
- Free property snapshots (zoning, overlays, pathway eligibility).
- DIY planning checklists and educational content.
- AI-assisted draft planning documents — Property Reports, Statements of Environmental Effects, RFI responses, Clause 4.6 variation requests, heritage impact statements, neighbour notification letters, pre-DA briefs, conditions-of-consent decoders.
- DA Packs that bundle the above into council-ready submission packages.
- Membership tiers that include discounted access + draw entries.
- A Trade-Promotion Lottery, regulated by NSW Liquor & Gaming.
3. What we are not
- We are not a town planner, architect, lawyer, building surveyor or registered engineer. Our outputs are AI-assisted drafts intended to be reviewed before lodgement.
- We do not provide legal advice. If you need legal advice about your planning matter, engage an Australian Legal Practitioner.
- We do not guarantee DA approval. Approval is at the discretion of the relevant Council, Joint Development Assessment Panel, Tribunal or Court.
- We do not certify designs. Class 2/3/9C designs in NSW must be declared by a Registered Design Practitioner under the Design and Building Practitioners Act 2020.
4. Acceptable use
- You must be 18 or over to create an account.
- You must give accurate information when you sign up.
- You must not upload documents you don't have the right to upload (e.g. someone else's confidential plans).
- You must not use the service to harass, defame, or otherwise harm anyone.
- You must not attempt to circumvent rate limits, scrape our content, or reverse-engineer our AI prompts at scale.
- You must not use the service for any unlawful purpose.
5. Pricing + refunds
- Subscriptions renew automatically until you cancel from /me/account. Cancellation takes effect at the end of the current billing period.
- DA Packs + à la carte purchases are one-shot. You retain access for the period stated (30/90/180 days). Refunds available within 14 days of purchase if you haven't downloaded or substantively used the output.
- Australian Consumer Law guarantees: our service is supplied with non-excludable consumer guarantees including acceptable quality and fitness for purpose. Nothing in these terms limits your ACL rights.
6. The draw
HOC runs a Trade-Promotion Lottery under permit from NSW Liquor & Gaming. Draw-specific T&Cs (permit number, opening + closing dates, prize description, free-entry route) are published on the relevant draw page. By entering you accept those draw-specific T&Cs in addition to these general terms. Entries are granted only as a benefit of paid subscriptions or qualifying engagement — never sold. 7. AI-assisted content
Documents and analyses we produce are AI-assisted drafts. Every draft is labelled as such and accompanied by a citation trail showing the source data and applicable regulations. You are responsible for reviewing the draft before lodging it with any authority. If you lodge an HOC draft to a court or tribunal, the Federal Court's GPN-AI Practice Note and equivalent state-level disclosure rules may apply — we provide disclosure-ready text generators in the Pro tiers to help you meet those obligations.
8. Intellectual property
- You retain ownership of the documents you upload.
- You grant HOC a licence to use those documents solely to provide the service to you (including running them through extraction + drafting pipelines).
- HOC retains ownership of the platform, the underlying compliance engine, our prompts, and our static catalogues.
- Government materials we display (Acts, SEPPs, Codes) are reproduced under their respective Crown copyright licences (CC BY 4.0 in most jurisdictions). Western Australian government materials are linked only and not rehosted, in compliance with the WA non-commercial restriction.
9. Liability
To the maximum extent permitted by law, our liability for losses arising from your use of the service is capped at the fees you have paid us in the 12 months preceding the event giving rise to the claim. We do not exclude or limit liability that cannot be excluded by law (including the non-excludable ACL consumer guarantees).
10. Termination
You can close your account at any time. We can suspend or terminate accounts that breach these terms, with notice where reasonable. On termination, your access to the service ends but your documents are retained per the retention schedule in our Privacy Policy.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the NSW courts. ACL disputes can also be brought before relevant Tribunals.
